DMCA Takedown Policy

Formal DMCA takedown procedures, 17 U.S.C. § 512 safe harbor provisions, counter-notice protocols, and 3-strike repeat infringer rules.

Media2URL respects intellectual property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) ('DMCA'). We maintain strict procedures to process takedown notices, counter-notices, and account terminations for repeat infringers.

1. Submitting a Valid DMCA Takedown Notice

Monitored DMCA Agent Intake: Copyright owners or authorized legal agents must send notices to support@media2url.com with the subject line 'DMCA Notice'. To satisfy statutory requirements under 17 U.S.C. § 512(c)(3), your notice MUST include: (1) A physical or electronic signature of the copyright owner or authorized agent; (2) Specific identification of the copyrighted work claimed to be infringed; (3) The exact Media2URL direct URLs or share-page URLs containing the allegedly infringing file; (4) Your contact information (full legal name, mailing address, telephone number, email address); (5) A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law; and (6) A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner.

URL Specificity Mandatory: Broad, non-specific requests (e.g., 'remove all my photos from your site' without exact URLs) cannot be processed.

2. Takedown Actions & Statutory Liability Warning

Expedited Link Disabling: Upon receiving a compliant DMCA notice, Media2URL will promptly disable access to the specified asset URL and notify the uploader.

Section 512(f) Fraud Penalty: Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to severe legal damages, court costs, and attorneys' fees.

3. DMCA Counter-Notice Procedure

Uploader Dispute Process: If an uploader believes a file was removed due to mistake or misidentification, a counter-notice may be submitted to support@media2url.com containing: (1) Physical or electronic signature; (2) Identification of the removed material and its original URL; (3) A statement under penalty of perjury that the uploader has a good-faith belief the material was removed by mistake or misidentification; (4) Consent to the jurisdiction of the Federal District Court for the judicial district in which the uploader's address is located (or San Francisco, CA if outside the U.S.); and (5) Agreement to accept service of process from the original complaining party.

Restoration Window: If the copyright claimant does not notify Media2URL within 10 to 14 business days that a legal court action has been filed seeking a court order against the uploader, Media2URL may restore the disabled file.

4. Strict 3-Strike Repeat Infringer Termination

Account Termination: Media2URL enforces a strict repeat infringer policy under Section 512(i). Any account receiving three (3) separate valid, unappealed DMCA takedown notices within a 12-month period will be permanently terminated, all workspace assets deleted, and future registration prohibited.
